I think why the mortgagor bank doesn't do the whole process rather than pass it to the investment bank is because it wants to make the mortgage under a separate entity that has its own credit rating, so the rating will be higher than the mortgagor rating itself. Am I right? thanks

@speculatorMan not really. What Sal is saying is that when you take out an interest only mortgage you don't pay any of the capital back until the end of term (which in this case is 10 years) and so every year you pay back the interest on the $1m that you borrow which is $100k. This means you pay back $100k every year for the 10 years but then at the end of the term you still need to pay the amount you originally borrowed so the payment in year 10 is $1m + $100k. Hope this helps.

I am a mortgage underwriter and PMI is for conentional loans only. FHA loans have MIP. This is not new. No, mortgage insurance is not required on a conventional loan when 20% is down. If less than 20% PMI is required. The 3% loan he speaks of is now 3.5% now in todays market is an FHA loan. Most folks that do not speak on that type of loan is not approved to do FHA loans. Not too many companies do 2nd liens any more. The lender is the best loan to do because the fees are less.

Mmmmm, that doesn't make sence. I work for Bank of America, and the normal customer is required to put down 20% to not pay PMI. You don't need to pay PMI, unless you have less than 20% equity in your home. Please talk to me if you have any other questions

Even when one of these lenders goes bankrupt there are banks making money on that as well. All of this is about making money while it looks to the public as though they are not. Example, One West Bank bought Indymac's loans now garanteed by the govt for 80% of the orig loan amount. Even as they got a discount on the cost of the loans they bought. They then sell the defaulted property to an invstor. The govt pays them 1st for the "loss"and the investor pays them 2nd for the house.

to the all mortgage paying ppl out there. even if you have a good deal with your current lender it is always good to shop around to see if other recognised lender can give you better deal. even if you pay some penalty, remortgaging your property to a better deal can save some some monthly outgoing. sometime they can even incorporate other debt with your mortgage. so it is always better to shop around but make sure you go to recognised lenders.

It makes 5m risk free, but it could have made much more with some risk in the long run (according to this model) if it would keep its loans. The irony is that if banks starts to behave this way the banks who operates more traditional (not sell their loans) would be stuck with all the downside if (when) the housing market tanks. So a bank has every incentive to get rid of housing loans and make short term profits and thus further increase the incentive to make rotten loans.

i think it is because they are getting cash (lots of it) every time they try this model...then they can replicate it again and gain more cash in one short period of time rather than over the course of 10 years even if it would have been more. someone correct me if i am wrong.

Did you know that if you were to take your mortgage company or bank to court, like I'm doing now,that they cannot prove they gave you a loan and then come to you with offers to settle? @dekes58 I suppose on the one hand that's fair, with one of these bonds you are buying a fixed income asset, you expect to get your X% and no more, its not like a stock with a variable dividend based on performance. However I think it would only be fair if they put the money aside to make up for any defaults and if there was not enough defaults to use it all up at the end the bank could keep, it of course with banks being banks this would never happen.

This is why today we are seeing investment banks that are losing tons of cash through these deals that were top-heavy a few years ago in the housing market. I would like to ask a question when a regular bank gives out $1 billion worth of loans it uses fractional reserve banking rules to bring new money into existence - right? is it that when an investment bank buys these mortgages and sells them further - then existing money (i.e. savings) gets used. Now, that most of these mortgage backed securities have gone to dirt - so is it that existing money (i.e. money that is no longer debt) got destroyed? any responses are welcome

If 20% default, with the 50% recovery on their properties. In response to bubkboss1: Believe it or not, $4.2 trillion of the debt is actually owed to the federal government itself. That means it's owed to gov't agencies such as the Federal Reserve and Social Security. This kind of debt, ARGUABLY, doesn't have to be repaid. (Kinda like you paying back yourself). Secondly, most of the remaining $6.8 trillion is owed to domestic American citizens/corporations. The gov't owes China $1 trillion, which, comparatively isn't bad as saying "China owns us."

You're absolutely right. People took out mortgages they knew they couldn't afford simply because they expected to make a quikc profit by flipping the properties. The banks made those loans available, but those greedy flippers are the ones who chose to take a risks.

Remember; FannieMae MANDATED that loans be given out to people who wouldn't otherwise qualify under standard industry guidelines. All in the name of "home ownership for everyone". If a lender refused to give a loan to someone who qualified under the new, very loosened guidelines, that lender could be sued for discrimination. The lender wasn't the problem, it was FannieMae who required these loans and the home buyer who didn't read and understand the biggest contract of their lives.

There is no legal right for them to throw it out in the streets and break the law. All they can do is let it sit in the house until you are able to collect it or give you 24 hour notice that they are putting it in storage and send you the bill for that. They may not literally throw it in the street, but they certainly can remove your property out of the premises, secure it and arrest you if you try to re-enter as you become a trespasser once the evicition warrant has been posted and served. Although squatting may sound like the right thing to do as an activist movement, it's not very practical, especially here in Georgia. They'll just get the sheriff to throw your things in the street, as once the foreclosure has gone through, they have the legal right to do so. Go to your county courthouse and make sure the chain of ownerhsip of your original mortgage is recorded. If it's been assigned to MERS, you'll have to contact them to get that information.

Actually CRA loans are still considered profitable; see the House hearing with law professor Michael S. Barr, a Treasury Department official under President Clinton. Additionally, the brokers mentioned in the movie above are exempt from CRA. Had CRA applied to them, they wouldn't have been able to sell shoddy mortgages.

In no way were we intending to point out one guilty party, as the situation seemed to be a perfect storm of several different issues occurring at the same time. I think it is important to realize that there is rarely a single identifiable cause of problems of this size, while predatory lending was a major cause, so was the CRA (not all Clinton's fault either)... there were plenty of other factors that contributed to the problem as well.
